Privacy Notice
David Koster PA, operator of PenthouseLife.com ("PenthouseLife," "we," "us," or "our"), explains in this Notice how we collect, use, disclose and protect personal information through PenthouseLife.com and related features that link to this Notice (the "Site"). This includes browsing, accounts, saved properties, searches and alerts, real-estate inquiries, subscriptions, communications and directly submitted media.
This Notice describes our information practices. Acknowledging it or accepting our Terms of Service does not, by itself, provide consent to optional analytics or marketing calls, texts or emails. We request separate permission where needed.
1 Who is responsible for your information
David Koster PA is responsible for personal information processed for PenthouseLife's purposes. PenthouseLife is a real-estate information, marketing and referral site. It is not itself a substitute for a separate brokerage relationship or transaction agreement.
ONE Sotheby's International Realty, listing agents, referral partners and other real-estate professionals may receive relevant information to handle a request. They may process it independently under their own privacy notices and legal obligations. This Notice covers our processing; it does not govern services we do not control, even when we link to them.
2 Information we collect
The information collected depends on the features you use.
Contact and account information: name, email address, telephone number, account identifiers, authentication information, communication preferences and, if provided, brokerage or company affiliation. Email and password registration is handled through our authentication system. Social sign-in provides identifiers and profile information authorized through the selected provider; it does not provide us your social account password.
Property interests and requests: saved properties and searches, selected locations and filters, budgets, purchase or sale timing, financing preferences you volunteer, inquiry messages, showing requests and related correspondence.
Media submissions: files, file metadata, property or listing references, accepting-person and submitter names, email addresses, entity and capacity information, credits, restrictions, permission evidence, withdrawal requests and associated correspondence. Submitted files can include images of people or identifying information about property occupants or rights holders.
Acceptance and preference records: the documents and disclosures presented, their versions, acceptance actions and times, checkbox choices, associated account or submission identifiers, form placement and source page. We also retain consent, withdrawal, unsubscribe and suppression records. Security information such as IP address and browser details may accompany these records.
Technical and usage information: IP address, approximate location derived from it, browser and device characteristics, session identifiers, referring pages, pages and properties viewed, searches, feature interactions, timestamps, errors, diagnostic information and security logs. Cookies and similar technologies are described in Section 5.
Communication delivery information: messages sent, delivery or failure status and related support records. If a communication uses permitted engagement measurement, it may also record whether a message was opened or a link was selected, subject to applicable choices and law.
We receive information directly from you, from your use of the Site, from selected sign-in providers, and from service providers and real-estate professionals handling a request. Property information may also come from MLSs, brokerages, licensed sources and public records. A public property record is distinct from your private account, saved search or inquiry.
The Site does not request payment-card details, Social Security numbers, government identification documents, medical information or precise device location for ordinary browsing or inquiries. Do not include those details, passwords or other sensitive information in messages or media submissions unless a separate, appropriate process specifically requests them.
3 How we use information
We use personal information to operate and secure the Site; authenticate users; provide saved properties, searches and alerts; respond to inquiries and arrange requested services; route requests to appropriate real-estate professionals; administer subscriptions; and communicate about accounts, security and requested services.
We also use it to understand Site performance, improve features, tailor property content to expressed interests, process media and enforce its permissions, document acceptance and communication choices, honor rights requests, prevent abuse, maintain appropriate business records, comply with legal and professional obligations, and establish or defend legal rights. Marketing communications are subject to Section 6.
We may use aggregated or deidentified information for these purposes. Where we maintain information as deidentified, we take reasonable measures to prevent reidentification and do not attempt to reidentify it except as permitted by law.
4 When we disclose information
Real estate inquiries and referrals
When you request information, a showing or assistance buying, selling or leasing, relevant contact details, property interests and request information may be provided to David Koster, ONE Sotheby's International Realty and personnel handling the request, a listing agent or brokerage, or a licensed referral partner or brokerage in the relevant market. Your inquiry is not necessarily sent only to the listing agent.
Recipients may contact you to respond to the request and handle related services. We do not authorize unrelated use of inquiry information. Any separate marketing permission must be obtained where required; permission for a PenthouseLife text program is not permission for another brokerage's text program.
Where lawful, a completed referral or transaction may generate compensation through the applicable licensed brokerage. Some privacy laws treat certain compensated referrals as a sale of personal information. Where those laws apply, you may request an applicable sale opt-out under Section 10. Disclosures you specifically request are handled subject to applicable legal exceptions and limits.
Providers supporting the Site
We disclose information to providers supporting hosting, databases, authentication, storage, content delivery, security, email delivery, support, maps, analytics and related operations. They receive information needed for their functions and are subject to applicable contracts and law. Some third-party integrations also process information for their own purposes under their privacy notices, as described in Section 7.
Submitted media and public content
Media approved under the separate Media Authorization and License, or another applicable agreement, may appear on the Site and in permitted communications and marketing channels, subject to accepted restrictions. Disclosed credits and contributor information intended for publication may accompany it. Public material can be indexed, copied or independently shared by others.
Private inquiry messages, account preferences, full acceptance records and supporting permission documents are not made public merely because a submission is approved. They may be disclosed to authorized personnel, providers, advisers or others where necessary for the purposes in this Notice. Avoid submitting private details within files intended for publication.
Legal matters and business transactions
We may disclose information as reasonably necessary to comply with law or lawful process, investigate fraud or abuse, protect rights or safety, resolve rights complaints, or establish and defend claims. Information may also be disclosed under appropriate confidentiality protections in a proposed or completed financing, reorganization, acquisition, sale or similar transaction. We may disclose it at your direction or with separately obtained permission.
5 Cookies and site analytics
We use cookies, local storage and similar technologies for authentication, security, requested preferences and Site functions. Optional site analytics help measure traffic, feature use and performance. We do not use advertising pixels, remarketing audiences or cross-context behavioral advertising.
Optional analytics technologies operate only after you enable them through the Site's cookie choices. You can decline them without losing ordinary browsing or inquiry access, and change your choice through Cookie Settings. Declining optional analytics does not disable necessary security, authentication or operational records.
Analytics providers receive technical and interaction information needed for measurement. Our analytics configurations are intended to exclude form messages, contact details, passwords, media-portal tokens and private permission evidence. Embedded maps, videos and sign-in services may separately receive technical information when you use them; their providers' notices apply to their processing.
Your browser can also restrict or delete cookies, although doing so may affect sign-in or preferences. We do not change our practices solely in response to a legacy browser Do Not Track signal. We honor recognized universal opt-out signals, including Global Privacy Control, for processing covered by the signal where applicable law requires it. A universal opt-out is distinct from a request to delete an account or stop a requested property alert.
6 Communications and marketing choices
Providing contact details for an inquiry allows us and the professional handling it to respond to that request, subject to applicable law. It does not automatically enroll you in unrelated marketing. Account notices, security messages, submission receipts and property alerts you request are handled separately from general promotional subscriptions.
You can unsubscribe from marketing email using the link in the message or contact us. Manage requested property alerts through the relevant controls or contact us to stop them. Unsubscribing from marketing does not prevent necessary non-promotional account, security or request-related communications.
Where required, marketing calls or texts, including automated communications, require a separate disclosure and affirmative permission. Terms acceptance, a media upload, an unchecked marketing box or a general telephone preference is not that permission. Consent to marketing calls or texts is not a condition of obtaining real-estate services.
If you enroll in a text-message program, its disclosure describes the program and any applicable frequency and charges. You can reply STOP to stop that program and HELP for assistance, or contact us. We do not disclose SMS opt-in information or consent records to other parties for their own marketing. Providers may process them to operate the program. A telephone number may still be provided to a professional to respond to the inquiry for which you supplied it, as described in Section 4.
7 Social sign in and external services
Google or Facebook sign-in, when offered and selected, is subject to the provider's privacy practices. We receive the information permitted through that sign-in process. Our use and transfer of information received from Google APIs complies with the Google API Services User Data Policy, including its Limited Use requirements where applicable.
You may revoke an integration through the provider's account controls. Revoking it does not itself delete our records or cancel a requested service. To request deletion of Site or Facebook sign-in information, contact us using Section 14; no Facebook login is required to submit that request.
Maps, embedded content, external listing links, social networks and brokerage sites can collect information under their own notices. A disclosure about their processing is not permission for us to bypass an applicable consent requirement.
8 Automation and artificial intelligence
Search matching and alert tools use selected criteria and property data. They do not determine creditworthiness, financing approval or eligibility to buy or rent housing. We may use AI-assisted tools for editorial, property-content and technical workflows. We do not use private inquiry messages, account credentials, saved-property notes or acceptance evidence to train AI models, or intentionally submit those records to editorial content-generation services.
Media adaptations and any separate AI uses remain subject to the applicable Media Authorization and underlying rights. This Notice does not expand a media license.
9 Retention and security
We retain information for the period reasonably needed for its purpose, taking account of the relationship, requested services, recordkeeping obligations, disputes and security needs. Account preferences and saved items ordinarily support an active account. Inquiry and referral records may be retained afterward for business, brokerage and legal obligations. Technical and analytics records follow configured retention periods appropriate to their functions.
Acceptance, media-permission and rights-request evidence may be retained after an account, lead, listing or media display is removed when needed to document permissions, compliance or legal rights. Limited unsubscribe and suppression information may remain to honor your choices. These records are not retained as a basis for restarting unwanted marketing.
Information no longer needed is deleted, deidentified or securely disposed of. Deleted records may remain temporarily in restricted backups until their normal replacement cycle. Restoring a backup does not authorize reactivating a deleted account, withdrawn media or suppressed marketing. Legal holds and applicable recordkeeping duties may require longer retention.
We use reasonable administrative, technical and organizational safeguards suited to the information, including access restrictions and secure transmission. No system can guarantee absolute security. Protect your login credentials and contact us if you suspect unauthorized use.
10 Privacy requests and other choices
Depending on the law applicable to you and our processing, rights may include confirmation of processing; access; correction; deletion; a portable copy; withdrawal of consent; restrictions or objections; and opting out of statutory sales, targeted advertising or certain profiling. Some laws also permit limiting particular uses of sensitive information and appealing a denied request. Rights are subject to applicable scope and exceptions.
Email info@penthouselife.com with the subject Privacy Request, or call 800-502-9033. State what you request and provide enough information to locate the relevant records. You do not need to create an account, accept new Terms or agree to marketing to make a request.
For access, correction or deletion, we may reasonably verify identity and an agent's authority to protect your information. For opt-outs, we request only information needed to identify and honor the choice and do not require identity verification where prohibited. Verification information is used to handle the request and related security, not for marketing. Avoid sending government identification or sensitive documents unless we provide an appropriate method and explain why they are needed.
We respond within applicable legal time limits and explain any permitted denial or limitation. We do not discriminate or retaliate for exercising applicable rights. For an appeal, email info@penthouselife.com with the subject Privacy Appeal, identify the original request and explain the issue. We respond and provide any further complaint route required by applicable law. You may also contact the relevant regulator directly.
Account deletion, marketing unsubscribe, withdrawal of media permission and a privacy request are different actions. Tell us which action you want. Media withdrawal is available through the receipt removal link or info@penthouselife.com under the Media Authorization. Necessary retained evidence and previously lawful disclosures are handled as described in this Notice and the applicable agreement; a privacy request does not eliminate another person's independent records or statutory rights.
11 Additional information for US state residents
Applicable state privacy laws may provide the rights described above. This section does not imply that every such law applies to PenthouseLife. Its duties depend on the law's scope, thresholds, exemptions and the processing involved.
For California Consumer Privacy Act purposes, the categories in Section 2 include identifiers; customer-record information; commercial information about property interests; internet or network activity; approximate geolocation; professional information for contributors; visual or other media information; and inferences about expressed property interests. Authentication credentials can be sensitive personal information. We do not request precise geolocation, financial-account access credentials or government identifiers for ordinary Site functions.
Sections 2 through 4 describe the sources, purposes and recipients for these categories; Section 9 explains retention criteria. We do not use sensitive personal information to infer personal characteristics. Section 4 addresses compensated referrals. We do not operate a contact-list sales business or use cross-context behavioral advertising.
Where California law applies, you may exercise applicable access, correction, deletion, portability, limitation and sale or sharing opt-out rights through Section 10. We do not knowingly sell or share personal information of people under 16. We do not offer financial incentives for providing personal information. California residents may also contact us regarding disclosures covered by California's Shine the Light law. Nevada residents may use Section 10 to submit a request concerning a sale of covered information as defined by Nevada law.
12 International processing
The Site is operated from the United States. Providers and real-estate professionals may process information in the United States and other countries with different data-protection laws. We apply safeguards required by the laws governing the relevant processing; your use of the Site alone is not consent to a transfer where separate consent or safeguards are required.
Where EEA, UK or Swiss data-protection law applies, David Koster PA is the controller for PenthouseLife's processing. Depending on the purpose, the legal basis is a requested contract or steps before it; legitimate interests in secure operation, support and recordkeeping, balanced against your rights; consent for optional analytics or communications requiring it; or an applicable legal obligation. Withdrawing consent does not affect earlier lawful processing.
Subject to applicable law, you may request access, correction, erasure, restriction or portability, object to processing, and complain to the competent data-protection authority. You can contact us about these rights or applicable transfer safeguards using Section 14. You need not contact us before approaching a regulator.
13 Children and changes to this Notice
The Site is intended for adults. Accounts, real-estate submissions and interactive features require age 18 or older under the Terms. We do not knowingly collect children's personal information for these features. If you believe a child supplied information, contact us so we can investigate and take appropriate deletion or other protective steps.
We update this Notice when our practices or requirements change and revise its dates and version. Material changes receive additional notice where required. We obtain new consent where law requires it; posting a revised Notice does not by itself authorize new consent-based uses or replace a media grant. Nothing in this Notice limits a mandatory privacy right or regulator complaint right. We may provide this Notice in other languages for convenience; if a translation conflicts with the English version, the English version controls to the extent permitted by law.
